HB 954 - This act clarifies the blood-alcohol content (BAC) limits that trigger the "zero tolerance" license suspension and revocation procedures for minors. Current law states that all persons under 21 who have a BAC of .02 or above are exempt from filing proof of financial responsibility with the Department of Revenue and can have the records of their suspension or revocation expunged. This act clarifies that persons under 21 who are also over the legal limit for intoxication (currently a blood alcohol content of ten-hundredths of once percent) do not qualify for the relaxed reinstatement and expungement provisions and are instead subject to the same license provisions that apply to any other person who is over the legal BAC for intoxication. Only persons under 21 years of age who have a blood alcohol content of at least .02 but less than .1 will be able to take advantage of these provisions.
